These Terms & Conditions apply to purchases made through the OMITSUTA online shop.

ORDERS

By placing an order through the website, you confirm that the information provided is accurate and that you agree to these Terms & Conditions.

After placing your order, you will receive an order confirmation by email.

OMITSUTA reserves the right to cancel and refund an order in the event of a stock error, pricing error, payment issue or other circumstance preventing the order from being fulfilled.

PRODUCTS

OMITSUTA offers two collections: Original and Studio.

Original includes artisanal shibori pieces made to order in Switzerland, as well as selected pieces made in Japan and available ready to ship.

Studio pieces are designed by OMITSUTA, developed in collaboration with a Japanese company specialized in shibori and produced at their production facility in China. Studio pieces are available in stock in predetermined colors and sizes and are not customizable.

Because shibori transforms the surface of the fabric through folding, binding and pleating, slight variations and visible traces of the process may occur. These are part of the character of the technique and are not considered defects.

Product colors may also appear slightly different depending on screen settings and lighting.

PRICES & PAYMENT

Prices are displayed in CHF unless otherwise indicated.

Available payment methods are shown at checkout.

Any import duties, customs fees, local taxes or other charges imposed by the destination country are the responsibility of the customer unless otherwise stated at checkout.

SHIPPING (cf shipping and return policy)

Orders are shipped from Switzerland.

Available shipping methods, rates and estimated processing times are indicated on the Shipping & Returns page and/or during checkout.

International orders may be subject to customs processing, which can result in delays outside OMITSUTA’s control.

RETURNS & RIGHT OF WITHDRAWAL (cf shipping and return policy)

Return conditions depend on the type of product purchased and the customer’s applicable consumer rights.

Where a statutory right of withdrawal applies, including for eligible consumers in the European Union, the customer may withdraw from an eligible online purchase within 14 days of receiving the goods.

The customer is responsible for return shipping costs unless otherwise required by applicable law or the product is defective.

Returned products must be returned in their original condition and must not have been used beyond what is reasonably necessary to inspect them.

Customized or personalized made-to-order products cannot be returned or exchanged for a change of mind where the applicable law provides an exception for goods made to the customer’s specifications or clearly personalized.

This does not affect any statutory rights relating to faulty, damaged or incorrectly supplied goods.

MADE-TO-ORDER PRODUCTS

Production of a made-to-order product begins according to the estimated timeframe communicated on the relevant product page or order confirmation.

Where a product is customized or made according to the customer’s specifications, the order cannot normally be cancelled, returned or exchanged once production has begun, subject to any mandatory rights under applicable law.

CARE

Customers are responsible for following the care instructions provided with the product and/or displayed on the website.

Damage resulting from improper care, excessive heat, tumble drying or use contrary to the provided care instructions is not considered a manufacturing defect.

INTELLECTUAL PROPERTY

All OMITSUTA designs, photographs, text, graphics and other original content displayed on this website remain the intellectual property of their respective rights holders and may not be reproduced or used commercially without prior permission.
